Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and 17524218 CANADA INC. doing business as HyperGirls.ai ("Company," "we," "us," or "our").

By accessing, registering for, or using the HyperGirls.ai platform (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease use of the Service.

1. Strict Age Requirement (18+)

Access to HyperGirls.ai is strictly restricted to individuals who are at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is higher). By accessing the Service, you represent and warrant that you are legally an adult. Accessing this Service as a minor is a violation of these Terms and will result in immediate termination and reporting to relevant authorities if applicable.

2. Service Description & "As-Is" Nature

HyperGirls.ai provides AI-powered tools for the generation of hyper-realistic digital imagery and text. The Service is provided solely for entertainment and novelty purposes. We make no guarantees regarding the quality, realism, or fitness for a particular purpose of any content generated.

3. Acceptable Use & Prohibited Content

ZERO TOLERANCE POLICY

Violation of the following content rules will result in an immediate, permanent ban without refund, and may result in a report to law enforcement.

You agree NOT to use the Service to generate, upload, or share content that depicts, promotes, or implies:

Child Sexual Abuse Material (CSAM): Any depiction of a minor or anyone appearing to be a minor in a sexualized context.
Non-Consensual Intimate Imagery (NCII) / Deepfakes: You are strictly prohibited from generating images of real, identifiable people (including celebrities, influencers, or private individuals).
Illegal Acts: Violence, rape, non-consensual sexual acts, bestiality, necrophilia, self-harm, or terrorism.
Hate Speech: Content that promotes violence or hatred against individuals or groups based on race, religion, gender, or sexual orientation.

3.1 Prompt Injection & System Abuse

You agree not to attempt to "jailbreak," bypass, or manipulate our safety filters via "prompt injection" or other technical means. Any attempt to circumvent our moderation systems will result in the forfeiture of your account and all associated credits ("Coins").

4. User Content & Liability

4.1 User Responsibility

You acknowledge that you are the sole creator of content generated via your account. The Company provides the tools (the "pen"), but you provide the creative input (the "hand"). You are solely responsible for ensuring your prompts and the resulting content comply with all applicable laws in your jurisdiction.

4.2 Passive Conduit

You acknowledge that 17524218 CANADA INC. acts strictly as a passive conduit for the storage and retrieval of your generated content. We reserve the right to remove any content that violates these Terms. If you upload or generate illegal content that is automatically stored on our servers, you accept full liability for that action.

4.3 Indemnification

You agree to indemnify, defend, and hold harmless 17524218 CANADA INC., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; or (c) your violation of these Terms.

5. Intellectual Property

Subject to your compliance with these Terms, you own the rights to the content you generate using the Service, to the extent permitted by law. You grant 17524218 CANADA INC. a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your content as necessary to provide the Service.

6. Coins, Payments, and No-Refund Policy

6.1 Virtual Currency

"Coins" are a virtual license to use our software tools. They have no monetary value, are not legal tender, and cannot be redeemed for cash or refunded.

6.2 No Refunds

ALL SALES ARE FINAL. Because the generation of AI content incurs immediate computing costs on our servers, we do not offer refunds for Coins or subscriptions once purchased. By making a purchase, you acknowledge and agree to this policy and waive any right to chargeback.

6.3 Termination

We reserve the right to terminate your account and revoke your license to use purchased Coins immediately and without notice if you violate these Terms. In the event of such termination, you forfeit all remaining Coins.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 17524218 CANADA INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST SIX MONTHS.

9. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You irrevocably submit to the exclusive jurisdiction of the courts located in Hamilton, Ontario.
